With worrying if the new flat track gets done or not. Going through a total chit show at work and had 18" of snow on the track. I don't have the time or patience to deal with anymore of the same crap I've been dealing with at the Flat Track. I cleared the driveway 3 times and made a path around the track to help it dry faster 2 weeks ago. Heard a snap sound in the skid steer and had an idea what it was but couldn't be sure because the heater is in the way. Was going to clear more snow last weekend but had to check what I thought might be the problem. Sure enough the chain adjuster bolts snapped off but very fortunate only 2 of the 3 bolts broke and I got the machine back in the shop to work on it. Blocked it up, took the wheels and chain case cover off and got it apart. Got some new bolts and some square bar to weld them together because there is no way to get a wrench on them on the inside. Needs 2 people to reassemble. Bolts break under heavy load if chain gets too loose.

As it happened the guy helping me with the flat track had called Thurs. out the blue seeing how things were going. I asked him if he could help me Sat. and if he still had the welder on his truck because mine hasn't been started for 7 month's or so. Welder still on truck but has an important union meeting/vote at 9am on Sat. so might have to wait till Sunday. OK, was going to call me Sat and let me know. I left a message about 12:30. A few hours later got a text, can't talk still in meeting and would call me when meeting was over. Never got a call. OK maybe he'll call Sunday morning. About 9:30 Sunday got a text he went to dinner with a few old buddies after the meeting, had a few drinks... and is feeling sick today but we'll get it fixed next Sunday! At this point I don't care anymore. I'll get my welder going and get someone else to help me. All I need is for someone to start a nut inside the cab to hold the adjuster up. My thought was if the guy came out would be a perfect time to talk to him about the track and his commitment/lack of commitment to it and I was getting a lawyer to do up an agreement like any good partnership should have (I know it should have been done at the beginning). Next Sunday is going to be... Unless he comes up with some kind of miracle solution I don't think I have any other choice but to dissolve the relationship? Never met anybody more unreliable and full of excuses than this guy!!!

Don't spend any more money related to the Flat track

I pay you back what you put into the track, X amount down and paid over 2 or 3 years from money taken in at Flat Track events (you get your money back and have no responsibility at all). paying over time is incentive for him not to bad mouth me to dealers and potential users of the facility.

You buy me out completely (land, shop, zoning and equipment) and have full control of both tracks to do whatever you want.

We both take a loss and go our separate ways (don't think he'd go for this, I'd still have the track)

Only other option MAYBE??? worth considering
You lease the flat track and do all the work with your own equipment and I get 50% of all monies collected for every thing that goes on at the flat track. (50% is the common rental for events but the track owner usually does a lot of the prep work). I do the work with my equipment he pays me in addition to the 50%.

Shhheeeesh Dave !
It is the same old story with that jerk. He is using every excuse he can come up with to avoid you.
I mean what the hell, he won't even come and help fix your machine that you are using on his track.
You need to get away from him any way you can before him and his girl girlfriend ruin your reputation, your financial situation and your sanity.
Cut your losses and run.

I have a gut feeling they're still upset that I questioned the pamphlets they made up for the motorcycle show. Didn't even consult with me. You wouldn't even know I was involved with the facility and I own it! If he tries to claim he has no idea why I'm at the end of my rope, I wasn't born yesterday. Maybe they figure if they pizz me off enough I'll tell them to look after the track. I could do that, not lift a finger and get 50% of all monies paid for use of the track. That would actually be a better deal and a lot less work for me. A while ago he asked about putting more money in and owning part of the property but that was never an option. If he wants to pay the right price to buy me out is the only way he gets to own any of the property but he can have 100%.

get the lawyer and put an END to it and get him out ,, if he wants to buy you out make it thru a bank (so you get your money) and let them deal with him not paying them ,

Do not go with the last option, the guy sounds as dishonest as they come, do you believe he would be honest about how much money he made off each meeting/event and give you 50% of that! your best option is that first one, pay him out, 5 years of installments should be sufficient time to get on your feet and running, but with a caveat that he and the wife/girlfriend cannot become involved in any other Flat Track in the area until you have paid him out, as you say this then stops him from trying to rubbish you and make another event/track to take your business.
