Quarry Issues.

I ordered some class 3 channel liner. Supposed to be 9" to 12" in size. I was sent shot rock. I was there for the first load and questioned it. The following loads were worse. One pic I have the rock is 32" long. The engineer is kicking on it , so is the owner leaving me to deal with the quarry , its on my account and done paid for. The problem the owner and NRCS people don't want to compensate me for it. The rock sent was not screened , the operator told me it was picked by an excavator. I sure hope I don't have to eat 3k in shot rock/class III liner for Christmas.

Did the owner or engineer single source the material? If not, I don't see how it's any concern of theirs.

Why did you accept load after load of improper material?

First I would not accept out of special material, and second, NEVER pay for out of special until they make it right.

If you clearly ordered a spec product and we're delivered something else, the seller should be obligated to make it right by you, just like you are obligated to complete your contract according to spec.

That's a bummer .

Sounds like they hauled in 10 loads give or take ? Depending on the job I might allow the first load & have the driver radio back to the quarry over the mistake & have it correct on following loads or quick yell on the cell phone .

On a positive note I have used " shot rock " in the past lining water channels . Little harder to deal with but it works .

They hauled 5 tri axle loads in. I called after the first load and the operator told me 9" to 12". I responded back the material sent was a lot larger. I'm not above taking my loader out there and digging it back out but not on my dime. My excavation was to be 18" deep , had to go 3' to get this stuff in the hole. I did talk to one of the managers and he said since I put it in the hole I was able to use it so he didn't see a problem. The problem , its on my account they don't want to pay for the extra rock to cover it which was about 1500$ worth. The manager also told me they didn't screen it so that tells me its not sized properly. The bigger problem they own all the other quarries around me and have territory agreements with the closest one which is 35 miles away. The reason I did not send it back , the plan called for it , I ordered it and the truck driver verified that it was class III. More like class VII. The only thing I asked them to do was help me out on the 3 loads of class 2 that I needed to cover it. I think that's fair enough.

Despite working in a quarry for 40+ years never got into the stone spec. part of the business. But if I had ordered a box of 100 3/8-16 by 1.5 inch bolts and they shipped me a box of 5/8-10 by 3 inch bolts I sure would not expect to have to spend my money drilling and tapping the holes for the wrong size bolts!

I take it your working in some kind of waterway & this is an erosion control project ?

From what I understand you had to over dig to get the " shot rock" in . Now need a 2 or 3 more truck loads to finish up the project and that's the $ 1,500.00 .


I might take some time & explain to the engineer that " shot rock " is the best & most cost effective when dealing with moving water .

It's got a little bit of everything in it from small boulders to rip rap ,gravel & fines . It all locks together & the boulders help shield the fines from water currant and the fines help lock the boulders in place .

Army Corps of Engineers use shot rock any where there is high current & wave action . It works .

Probably best bet is ask the land owner or NRCS to help meet you in the middle somewhere on the extra cost & move on .

Sounds like if anything you did your best and now the job is really over specifications.

I'll get some pics up. The engineer told me he never thought the job would look as good as it does. Not that anybody else couldn't do it. The other thing , I have been spear heading this for the owner for 3 years to get his grant. I only asked to be paid for what time the machinery was working. Top it all off we had a big rain and it rolled up the straw blankets. Its a good job gone bad. Not my fault, I get tired of dealing with this crap. And the owner bought 2 new Dodge eco diesels , my bill is 30 grand. I let things get in my head as well.
