So it is legal to have a gun in your car and no entity can prohibit you from doing so.
Unless you commit a crime of any sorts while in that car with the weapon in the car, then they add Unlawful Carrying to your charges.
Remember he who calls 911 first is perpetuated as the victim when the police arrive.

We now have constitutional carry. You don't need a concealed carry license to have your weapon on your person. I don't personally carry it on me unless I feel that it is necessary. And I never thought that I needed anyone's permission to have it on my person. So I always kept it in the truck. My theory was if trouble followed me to the truck. Then you fcked up. Because that meant that I was trying to get away from the trouble. I am not a hard-core gun advocate of any kind. My belief is if you want one then you should have one. As for me. I just try to not go to a place where I think that I will need to carry it on my person. But in this crazy world. That is getting harder to do. Hell some days I feel like I need it just to go grocery shopping. It's getting bad around here and I can't wait to get away. I suppose that this doesn't constitute as overloaded unless you count carrying a weapon with a extra clip. ;)

I've started seeing more of these types of accidents...probably has a lot to do with how powerful consumer grade trucks have become, yet the brakes and frame, and mass of the truck cant control the loads they're capable of getting moving.

Damned shame.

The world has become far to inept of these scenarios so this is going to be the result until dot drops the hammer on this crap witch will most likely end in an over regulation burden for those of us that roll honest an legal and safe

I see these overloaded trucks on the daily around here. My guess is there isn't more this type of accident. Is because it is largely flat around here. Our d.o.t. boys stay on the interstate and away from big cities. And the local p.d. is either not trained to spot these violations or they don't care. I just make sure that these trucks are ahead of me and I stay clear of them.

There are only so many DOT officers to cover how many miles of highway. They can't be everywhere at once.
So truthfully the best way is for the courts to make an example out of people who do things like the one above.
But that costs the courts money so the guy will plead guilty for a lighter sentence. Same with capitol offences
like murder. Counties don't want to try those because it's costly to the county in appeals that go on for years.
The laws are already in-place for vehicles of all types doing what ever. We will never be able to stop stupidity
you couldn't write enough laws to cover that. People always know they are doing wrong while they are doing it. The vehicles with high towing capacity need to be lowered it's gone far enough.

Sorry, Mike, but that is a perfectly legal load behind that tonner. That loader weighs in at 19,000, the trailer about 7000, and the pickup about 8500, for a total GCVW of 34,500 lbs, 5500 under the limit if it has 3.55 gears.
