and Steve, when I know I'm going to get screwed, I usually like to practice my positions beforehand. May I suggest the "over the barrel" pose. I'm currently trying to get a customer assistance from CAT on a failed engine at 2800 hours on a D6T. I will tell you this, I am NOT beyond walking into the service managers office and leaning over his desk with my legs spread if I don't get my way.;) Ill do it in front of a regional rep too. Its my way of making a point!

I understand your point but I want to see what they will do for me first .I believe in being nice to people who are working on something that I own. It's called"Minnesota nice "Maybe I am getting screwed, but let's see how this all plays out.

Stop and think... So all the lost time from their mistake cost you non use. You received no rental or loaner machine. Use that as leverage against whatever dollar they will try to stick on you. That should more than cover the simple radiator repair. After all, every bit of this repair is negligence on their part for not training the lawnmower mechanics about proper engine overhaul related systems functions.

Been thinking it, but didn't post it. If Steve wants to play nice then so be it. Ill be looking for his explosion on here soon enough.

Steve's first post goes back to November 2016. I don't think this dozer has run 10 minutes since, and the downtime alone adds up to more than what he has in repair costs with no resolution in sight. Its way past time to be nice He's the "little guy" that gets squashed by CAT just like the rest of us do when THEY FK up. At what point exactly do you stop putting up with their BS? There an old saying......."The squeaky wheel gets the grease". The days of " You attract more flies with honey then $hi*" are over with these dealers now days. This is all just MY humble opinion...............based off BS I see daily anymore.
I had a customer 2 months ago take a D3K in for hard starting. I looked at the machine BEFORE he took it to CAT, but didn't have time to do the job in his timeframe. It went to CAT. They installed a new pump and injectors,and ran it, but called him to let him know he had a bent valve? It didn't have a bent valve when it was picked up, I ran the engine myself beforehand. There was nothing he could do at that point, NEW head and $15000.00 when he picked it up.

*Edit*. That actually puts the ball in their court. Be MN nice and say "Do you mind if I take it and run it a bit to make sure it's right? I'll be back in a couple days with a check if all is well." Sometimes you gotta be smarter than the average bear and beat em at their own game. Damn sure wouldn't pay em and then try to get your $ back. It'll never happen.

That would be a better idea. Pick it up or get it delivered on a Friday and say you're going to run it over the weekend to make sure everything's good. Then let them come to you for payment.

ESPECIALLY if THEY have to deliver it..
I stand by my statement.. pay w/ a CC.. & once you get home.. dispute the charges.. the CC co. puts a freeze on payment UNTIL an agreement is reached & all is settled.. THE CC co even have "moderators" that will intervene on his behalf..
Just be sure to wait until the machine is delivered before you pull this stunt..
THATS another thing.. once the machine is finished.. how you getting it home??
CAT?? or private carrier?? Don't pay the bill & THEN try to figure it out.. have a plan in place..
IF its CAT.. don't let them tell you, "it'll be A COUPLE OF WEEKS before we can get someone out there".. THATS B.S.!!!
They just wanna make sure they get YOUR MONEY before they deliver it..

I would be extremely (as in to the max) surprised if cat lets this tractor off it's plantation without full payment in hand. they read this thing too.

it is painfully obvious they know one individual (farmer) will not have the monstrous legal sources needed for the disputed CC court case. they will leave one component off the tractor till they get their money.

this isn't the first time they have been down this road.

Well guys, I found out that they are not going to cover the costs involved for the rebuild .They're saying that they are not responsible for the radiator being plugged, as to the cause of the engine failure .The bill to complete putting it back together is A LOT more than what the machine is worth .I have to consider the options that they presented to me. I don't like any of them ,but I have to make a decision on what to do .Thanks for all of your comments ,you guys have been SO helpful ...

I would be consulting a lawyer. There are too many discrepencies to their story. The temp gauge that was replaced, but still didn't work. Where is that documented? Did they forget to document the replacement? The fact that a 50% plugged radiator should not cause an overheat under minimal load. ( You driving across the field) As many of us have said, they will screw you over.

I hate to tell you, but walk away and let them keep the machine will be your best bet...for several reasons..1-its not worth it financially, 2-will it run and for how long and 3- who knows if they screwed with it on purpose to fail down the road, 4-you will spend lots more on lawyers and probably get no where and after a legal battle refer to #3 again....take it as a loss against your farming business and move on...but you had to see this coming as most everyone else did...just consult a lawyer that you can trust on the best way out but either way it wont be pretty...
